Tribunal orders HBOS to pay mortgage adviser £22k

The adviser’s line manager proceeded to contact her a number of times after this leading up to Christmas.

Lindsay eventually contacted her trade union, who she emailed saying: “I feel that there is no way forward for me now with the bank and I think I am going to resign.”

The bank did not dissuade the adviser from resigning “despite advice to do so” and decided not to ask her whether she wished to continue to receive sick pay until the expiry of her fit note, again “despite advice to do so”.

Following her exit from the bank, Lindsay has set up a self-employed business as a mortgage protection adviser which launched in April.

Upon hearing the evidence, the tribunal concluded that the bank should pay the adviser £22,304.72 for loss of salary, pension and income while she set up her own venture.
